Summary of CCS Decision that Appeal Relates:

 

 

 

On 4 June 2010, the Competition Commission of Singapore (“CCS”) issued an infringement decision (“Infringement Decision”) to the Appellant, which found that the Appellant had abused its dominant position in contravention of section 47 of the Act. The finding of abuse of dominance was made in respect of 19 exclusive agreements that the appellants had concluded with various venue operators and event promoters, including The Esplanade Co. Ltd and the Singapore Sports Council. Pursuant to the Infringement Decision, the appellant was directed to the following :

  • Modify the agreements concerned and the Appellant’s contractual template to remove the requirement of exclusivity; and
  • Pay a financial penalty of S$989,000.

Relief Sought by Appellant

 

 

1. For the CCS’s Infringement Decision, and the directions contained therein relating to the modification of the Appellant’s exclusive clauses and the payment of the specified financial penalty, to be set aside; or in the alternative for the financial penalty imposed on the Appellant to be reduced; and

2.For the CCS to pay the Appellant’s costs of the appeal.
